Remain Silent & Compliant
Politely decline to answer questions beyond identifying yourself. You are legally obligated to provide your license, registration, and insurance—but nothing more.
Request Legal Representation Immediately
State clearly: “I wish to speak with an attorney before answering any questions.” This invokes your right to counsel under the Fifth Amendment.
Document the Incident
Note officer names, badge numbers, time/location of arrest, and any witnesses. Mental clarity post-arrest is critical—write down details as soon as possible.
Refuse Field Sobriety Tests (But Know the Risks)
In New Jersey, you may legally decline roadside sobriety tests (e.g., walk-and-turn, one-leg stand). However, refusal does not apply to breathalyzers—declining a breath test can result in separate refusal charges under NJSA 39:4-50.2.
